License Conditions

This software is distributed under the following terms and conditions. Should you decide to purchase a user license, you will be asked to accept these terms and conditions prior to the license becoming enabled.

The EQCalc and WindCalc software is distributed through this 1170Actions.com web site. Payments are required to be made by credit card at this site unless alternative special arrangements are made. The licensor is King Consultants Ltd.

1. Purpose

This license applies to the use and application of WindCalc and/or EqCalc. These software packages have been developed to provide results that, for WindCalc, conform to the provisions of AS/NZS1170.2:2002 and amendments 1, 2 and 3 and to AS/NZS1170.2:2004 for New Zealand and for EQCalc, conform to the provisions of NZS1170.5:2004 (the standards).

2. Disclaimer

While all effort has been made to ensure that data and algorithms used in EQCalc and WindCalc are the most accurate and up to date scientific data available at the time the software was written, the licensors provides no guarantee that better or more accurate data is not available at the time, nor that the algorithms used are a correct or complete inter-pretation of the standards

All calculations using the software and the data and output obtained should be independently verified to ensure compliance with the standards and any other relevant standards or codes. The EQCalc and WindCalc software are not a substitute for such independent verification.

3. Liability

The licensors expressly excludes to the full extent permitted by law liability for any damages, losses or expenses of any kind (arising in contract , tort or otherwise) suffered or incurred as a result of  any persons or organisations use of, or reliance on calculations performed by WindCalc an/or EQCalc, or for any decisions, buildings and constructions based on  these results or otherwise arising from your use of the software or the data and output obtained. The licensors specifically accepts no liability for any indirect or consequential damage or claims or for any third party claims. The licensors excludes all warranties express or implied.

You agree to indemnify the licensors from any damages, losses, expenses or claim resulting from use of or reliance on the software licensed or the data and output obtained by you or any third party.  

 4. Terms of software use

This license is valid for 12 months from the time of purchase. It is available either as a single site license, a 10 user license or as an enterprise license.

5. Payment

You shall, through the 1170Actions.com web site, pay the licensors for the license rights in accordance with the agreed payment terms. Failure to make any payment when due will result in termination of this license

6. Voiding of the license

 Notwithstanding the terms of clause 8 below this license shall be terminated if any attempt is made by you to disassemble, decompile or otherwise tamper with the program files, libraries or data files contained within the software  

7. Termination

Upon termination of this license any copies of the software shall be deleted.

 8. Third party libraries

 The EQCalc installation includes the iText library, which is included under the terms of the Mozilla Public License.  Please familiarise yourself with this license.

 9. Assignment

 This license may not be assigned transferred or sublicensed
